Third Report on State Responsibility
Introduction
The preliminary and second reports of the Special Rapporteur on State responsibility submitted in 1988[1] and 1989[2] respectively, dealt with the substantive consequences of an internationally wrongful act, namely cessation (art. 6), restitution in kind (art. 7), reparation by equivalent (arts. 8 and 9), and satisfaction and guarantees of non-repetition (art. 10). Abstract
This report considers the different kinds of measures to be taken into consideration, by analyzing self-defence, sanctions, retortion, reprisals, reciprocal measures, inadimplenti non est adimplendum, suspension and termination of treaties. It also examines the functions, conditions and limitations of countermeasures, as well as the substantive restrictions and prohibitions.
